Terms & Conditions
Anyone using NYShoppe service, platform, or site must follow the following terms:
- You agreed to NYShoppe terms and condition when using our website.
- Users must be at least 18 years old to use NYShoppe's service.
- Users under 18 must have their guardian or parents’ permission to use the service.
- Anyone who uses NYShoppe is automatically assumed to have agreed to its terms and conditions.
Disputes and Indemnification
Anyone dispute our website or its products/services, it would get handled by the proper courts or arbitration.
NYShoppe have the right to and will use appropriate legal counsel
User Registration
Users must:
- Keep their credentials confidential.
- Everyone is responsible for keeping their usernames and passwords safe from others.
- You must contact NYShoppe immediately if you believe your credentials get stolen, or you believe someone has gained unauthorized access to their accounts.
Acceptable Use
Prohibited Activities/Restrictions
We have the right to remove or delete any prohibited activities in our site, facebook page, telegram and other social media platforms for the followings:
- Removing or changing any trademark, copyright, or any other intellectual property notice
- Using any other user’s username or password
- Posting user content or registering usernames that are abusive, pornographic, offensive, obscene, discriminatory, or advocate violence
- Using NYShoppe for illegal activities
- Using the service to expose proprietary or confidential information of a third party or yourself that’s not intended to be shown to the world
- Copying or importing local files that you don’t have the legal rights to copy or import
- Scraping or crawling, whether by automated means or manually, to access, view, and collect information
- Reverse-engineering, dissembling, decompiling, modifying, or creating derivative works unless this restriction is specifically prohibited by applicable law
- Blocking advertisements or creating or distributing tools for blocking advertisements
Suspension and Termination
NYShoppe will suspend and/or terminate users for the following inappropriate behavior:
- Unpaid balance for more than 4 months from the order date.
- Scammers or Fraudster who impersonate as NYShoppe
- Advocating violence
- Posting discriminatory, abusive, threatening, pornographic, or offensive content
- Using the platform or site for illegal activities
- Sending junk mail, spam, or chain letters
- Exposing another user’s personal information, including username(s) and password(s)
Modifications and Interruptions
We reserve the right to change, modify or remove the content or the services from time to time to comply with new laws or regulations or to update our offerings. We also reserve the right to modify or discontinue all or part of our Services. We will not be liable to you or any third party for any modification, price change, suspension or discontinuance of the services.
Nothing in these terms of use will be construed to obligate us to maintain and support the services therewith.
CORRECTIONS
There may be information on the services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information.
We reserve the right to correct any errors, inaccuracies or omissions and to change or update the information on the Services, at any time without prior notice.
DELIVERIES AND SHIPPING POLICY
Shipping Policy
All orders will be shipped after full payment is received. Shipment is every week basis from USA to Melaka. Expected time arrival is 3 to 4 weeks from the shipment date.
Local pickup
Curb side pickup is available from Mon to Fri, daily from 10am to 4.30pm with prior written request no less than 48 hours from the pickup date
State and nationwide
We use the cheapest from J&T standard rate or upon written request other local carrier like Ninjavan.
International
We use the standard shipping partner for bulk shipment from USA to Malaysia.
Delays, damaged or stolen during shipment
- Shipping delays, please contact us in writing, so we can help resolve by contacting the shipping company.
- Please notify us in writing with pictures and/or video if the roducts get damaged during shipping
- Please notify us in writing if you believe the packages get stolen after delivery. We will file a claim with the shipper. The claim is subject to the shipper claim policy and procedures.
Deposit & Payments
We accept payment via the following options:
- PayNow OR Buy Now Pay Later, spilt 2, 3 or 6 months installment with 0% interest by Airapay.
- Credit Card / Debit Card.
- Online Banking - FPX (Maybank2U, Cimb Clicks, etc.)
- CDM - Cash Deposit Machine for approved customers Only. Minimum deposit of RM100 is required for each order, no exception, non refundable. Full payment is due, two months after the order date (live or off-live). Otherwise the deposit will be forfeited. Items will be opened for sale.
Returns, Exchanges, Cancellations and Refunds
If you are not satisfied with your order for any reason, we will accept the return of items that are in new, unused condition, with original tags attached and all original packaging and other components included, when accompanied by an original receipt/invoice or gift receipt.
Returned items must not be washed, worn or altered. We do not accept returns of swimwear, underwear, custom-made, face masks, engraved, or personalized items or Clearance items.
Credit for your returned item(s) will be refunded back to your account in the same form of payment used to purchase the item(s). The credit should appear on your next statement. You should receive an email confirming the completion of return processing.
You must return/exchange merchandise purchased by mail. All returns must be returned within 30 days from the day the order was shipped. Securely pack your merchandise, please try to use the original shipping box and materials.
Merchandise eligible for return or exchange must be:
- New, unused, unwashed and in good condition;
- Inclusive of all original hangtags, packaging, and components at the time of return or exchange; and
- Accompanied by an original receipt or gift receipt.
- NYShoppe does not accept returns or exchanges for merchandise purchased from other retailers
- Clerance items are all final sale.
Cancellations made 2 days after the live/order date, will receive a 100% refund. Cancellations made within 3 - 6 days after will incur a 20% fee. No refunds beyond 7 days from the live/order date.
Intellectual Property Notice
By agreeing to NYShoppe website terms and conditions, users are agreeing that:
- We own these marks and ideas.
- You will not sell, modify, rent, loan, share, or distribute our content in any way.
- Anyone will not use you material in any manner except for noncommercial, personal uses.
Digital Millennium Copyright Act Notice and Policy
We will remove any material that infringes users’ copyright according to the Digital Millennium Copyright Act.
